Mr. Sourjya Das ............for the petitioner Mr. Avinash Kankani .......for the respondent no. 3 The petitioner has challenged a communication dated 30.05.2022 stating that the petitioner's passport has been revoked.

The ground of challenge is that the petitioner is not given any notice of revocation under the relevant provisions of The Passports Act, 1967.

Learned counsel appearing for the respondent authorities takes up a point of maintainability on the ground that the order of revocation is an appealable order under Section 11 of the Act. Counsel also makes over the copies of the order of revocation as well as the show-cause notice to counsel for the petitioner during the course of hearing.

Learned counsel appearing for the petitioner submits on instruction that the petitioner will avail of the Section 11 route and challenge the order of revocation.

WPA 18179 of 2022 is accordingly disposed of in terms of the above.

However, since the petitioner has approached the writ court for relief, the petitioner is given liberty of preferring an appeal against the order of revocation before the designated authority under the Act within ten days from date and the concerned authorities shall dispose of the appeal within three weeks from the date on which the petitioner approaches the authorities.

Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertakings.
