Mr. Anjan Paul, Mr. Mridul Kanti Sasmal .....for the Petitioners. This application under Article 227 of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Jr. Division), 2nd Court, Uluberia, Howrah to dispose of an application under Section 151 of the Code of Civil Procedure filed in Title Suit No.134 of 2016 expeditiously.

The learned advocate appearing for the petitioners submits that three suits being Title Suit No.800 of 2015, Title Suit No.134 of 2016 and Title Suit No.175 of 2018 are pending in respect of the selfsame property and between the selfsame parties. He submits that the application under Section 151 of the Code of Civil Procedure was filed praying for analogous hearing of all the three suits.

In view of the order sought and proposed to be passed, there is no necessity to issue notice upon the opposite parties. However, the learned advocate appearing for the petitioners shall be obliged to

forward a copy of this application along with this order upon the opposite parties or upon the learned advocates representing them before the learned Trial Court.

In the light of the submission made by the learned advocate for the petitioners, C.O. No.2588 of 2024 is disposed of by requesting the learned Civil Judge (Jr. Division), 2nd Court at Uluberia, Howrah to make an endeavour to dispose of the application under Section 151 of the Code of Civil Procedure filed in Title Suit No.134 of 2016 as expeditiously as possible without granting any unnecessary adjournment to either of the parties provided the same is otherwise ready for hearing.
