Learned counsel appearing for the petitioner submits that on 09.06.2024, the petitioner began repairing a drinking water tubewell within the perimeter of his own property with the help of a local plumber, but the private respondent nos. 8 and 9 allegedly lodged complaint against the petitioner.

Learned counsel further submits that civil cases are pending between the petitioner and the private respondents and the learned Civil Judge (Sr. Division), 3rd Court, Krishnagar, Nadia had passed necessary orders in regard to the same, but the respondent nos.6 and 7 being the police authorities despite the order of the learned Civil Judge are continuously harassing the petitioner.

Learned counsel appearing for the State files a report regarding the same.

Learned counsel for the State submits that there is an ongoing dispute between the petitioner and the private respondents which is civil in nature and the police authorities are not interfering with the case but only executing the order of the learned Court below. Learned counsel appearing for the private respondents alleges that there is a civil dispute in relation to the property between the petitioner and the private respondents and the petitioner is forcibly repairing the water tubewell at the disputed property. Heard learned counsel for the parties.

The police authorities are directed to keep a sharp vigil at the locale, particularly with regard to the property in dispute and ensure that no harm is caused to the petitioner or his property and strictly comply with the order of the learned Court below.

The Writ Petition being WPA 18537 of 2024 is disposed of.

There shall be no order as to costs.
