Mr. Somik Ganguly Mr. Pradip Kumar Kundu Mr. Tapodip Gupta ... for the petitioner Mr. Jahar Lal De Mr. Nilotpal Chatterjee ... for the State Mr. Billwadal Bhattacharyya Mr. Debasish Tendon ... for the NIA In this public interest petition the allegation of the petitioner is that in his locality some outside persons, who are not the citizens of India, are residing at 476/1 Mahatma Gandhi Road, Budge Budge, South 24 Parganas, Kolkata. Various allegations have been made without any supporting materials against the so called persons residing in that address without even disclosing the names of those persons.

Learned counsel for the petitioner has submitted that the action under the National Security Act, 1980 should be initiated against them but he has not even substantiated this plea by pointing out in such a case NSA can be attracted.

Hence, we find that the writ petition has been filed without disclosing the necessary particulars. That apart learned counsel for the State has produced the report in the form of communication dated 22.08.2022 sent by the inspector-in-charge, Budge

Budge Police Station, Diamond Harbour Police District to Government Pleader disclosing the names of the persons who are residing in that address, their Adhaar Card number, etc. and also stating that the police is now keeping strict vigil on them to avoid any untoward incident. The report also submits that these persons are carrying requisite documents which are supposed to be of an Indian citizen.

Since the allegations made in the petition are unsubstantiated and even the names of the persons against whom allegations are made, have not been disclosed nor they have been made parties in this petition, therefore, we find that the writ petition is without any substance and accordingly it is dismissed.
