Since, the statutory order has been passed by the learned Judicial Magistrate, 5th Court, Hooghly while exercising its jurisdiction under Section 23(2) of the PWDV Act and the subject-

matter relating to the property is being exhausted under the SARFAESI Act as also the fact that the petitioner has also approached the Debt Recovery Tribunal by way of SA 225 of 2024, I am of the view that no interference is called for by this Court.

With the aforesaid observations, WPA 18540 of 2024 is disposed of.
