The report submitted by the learned advocate for the State reflects that on completion of investigation, charge sheet has already been submitted before the learned Trial Court. The proceedings before this Court relates as to a challenge in respect to the proceedings under Sections 498A/406/34 of the Indian Penal Code pursuant to a case registered by the Ekbalpur Police Station.
Having regard to the nature of the offence, I am of the view that the revisional application was made at a pre-mature stage challenging the FIR and the application under Section 156(3) of the Code of Criminal Procedure. Prima facie, the FIR discloses offence and as the charge sheet has already been submitted, I am of the view that the case must be taken to its logical conclusion. Accordingly, the revisional application is dismissed. Interim orders, if any, is hereby vacated.
The learned Trial Court is directed to proceed with the case in accordance with law.
As such, the CRR No. 2881 of 2000 is disposed of with the aforesaid directions.
Department is directed to communicate this order to the Court below.
