Learned advocate for the petitioner submits that the D/L4 04.08.2023 Bpg.

petitioner is in custody for about 60 days and charge-sheet has already been submitted before the jurisdictional court. Learned advocate for the petitioner further submits that on any stringent condition, the petitioner may be released on bail. Mr. Banerjee, learned advocate appearing on behalf of the State opposes the prayer for bail and submits that the petitioner was a bank employee who allured the complainant for investing the sum in her husband's construction company. The complicity, as such, in respect of the commission of offence under Sections 420/406 of the Indian Penal Code has completely been established. I have considered the submissions advanced by the learned advocate appearing for the petitioner as well as the learned

advocate for the State.

Having regard to the period of detention of the present petitioner and the fact that charge-sheet has been submitted and there is no possibility of the trial being completed very soon, I am inclined to release the petitioner on bail.

Accordingly, the petitioner namely, Poulami Nag shall be released on bail upon furnishing bond of Rs.10,000/- (Rupees Ten Thousand only) with two sureties of like amount each, one of whom must be local to the satisfaction of the learned ACJM, Barasat, 24 Parganas (North).

If on bail, the petitioner shall not leave the jurisdiction of the district of 24 Parganas (North) without the permission of the learned ACJM, Barasat. The petitioner shall be physically present on each and every date fixed by the learned trial court. With the aforesaid observations, CRM (SB) 158 of 2023 is allowed.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
