...for the appellant CAN 1 of 2020 (old CAN 506 of 2020) is the application for restoration of the second appeal fled by the appellant as the matter was dismissed for default on 3rd January, 2020.

Learned Counsel for the appellant submits that the matter has been settled between the parties out of Court and the appellant is not interested to proceed with the second appeal. Under such circumstances, we recall the order dated 3rd January, 2020. The appeal is restored to its file. The restoration application is, accordingly, disposed of. However, in view of the submission made on behalf of the appellant that the parties have settled their disputes out of Court, the appeal stands dismissed for non-prosecution.
