The petitioner was a Tower Wagon Driver in the South Eastern Railway at Kharagpur Division at the time when the writ petition was filed. The petitioner alleged about discrimination on the part of the employer in granting him voluntary retirement under the Liberalised Active Retirement Scheme for Guaranteed Employment for Safety Staff (in short" LARSGESS"). The petitioner has retired from the services of South Eastern Railway after attaining the age of superannuation during the pendency of the writ petition.

Nothing, therefor, survives as on date for adjudication as the whole challenge in the writ petition has spent its force upon the petitioner's retirement. The writ petition, therefor, is disposed of recording these facts.

Since I am not required to hear the writ petition on merits due to subsequent development, I am not called for to adjudicate as to the jurisdiction of this Court in receiving, trying and determining the writ petition.
