According to the petitioner, the property which is rented out has been sealed by the police authorities as the licensee has been implicated in a criminal case.

State has submitted a report which reflects that one Hemant Sikaria has been implicated in connection with Cyber PS Case No. 138 of 2024 dated 18.12.2024. The said case is pending

before the learned CJM, Calcutta.

As the property has been sealed by the police authorities and it has been the contention of the learned advocate for the petitioner that the petitioner has no relationship and/or any nexus with the said criminal case, I grant liberty to the petitioner to approach the learned CJM, Calcutta in seisin of the issue. The learned CJM, Calcutta, on an application of the petitioner, would call for the Case Diary and/or a report from the investigating officer of the case and, thereafter, if the learned Magistrate finds that there is no relationship of the petitioner with the said criminal case - which is pending, pass necessary orders as he/she deems fit and proper.

If such an application is preferred, the learned Magistrate would within a period of 30 days of filing of such application, dispose of the same.

With the aforesaid observations, WPA 17813 of 2025 is disposed of.

Pending application(s), if any, is also disposed of.

Report so submitted be kept with the record. A copy of the report be handed over to the petitioner.
