Mr. Biswarup Mukherjee Mr. Tanmoy Kar ...for the petitioner This application under Article 227 of the Constitution of India is at the instance of the plaintiffs praying for a direction upon the learned Civil Judge (Sr. Division), 1st Court at Barasat to dispose of Title Suit No. 189 of 2015 expeditiously. In view of the order sought and proposed to be passed, there is no necessity to direct issuance of any notice upon the opposite parties.

From the order-sheets appended to this application this court finds that the partition suit was decreed on preliminary form on September 26, 2022. Thereafter the final decree proceeding started. The Partition Commissioner submitted his report and September 6, 2025 has been fixed for evidence of the Commissioner and for filing of written objection in the meantime.

In view thereof, CO 2789 of 2025 stands disposed of by requesting the learned Civil Judge (Sr. Division), 1st Court at Barasat to make an endeavour to dispose of Title Suit No. 189 of 2015 as expeditiously as possible without granting any unnecessary adjournment to either of the parties, keeping in mind that the suit is pending from the year 2015.
