Heard learned counsels for the parties.

The petitioners are in custody for close to two years and pray for bail.

Learned counsel for the petitioners submits that the petitioners are similarly circumstanced with the co accused Tantu Babu @ Lalchand Sk. who has been granted bail by this Court earlier and two other co accused who have been granted anticipatory bail.

Learned counsel for the State opposes the prayer. This Court is informed that the de facto complainant has filed an application before this Court seeking cancellation of bail granted to Tantu Babu @ Lalchand Sk. The petitioners have been named by the eye witnesses to have dragged away the victim prior to his death. The victim was murdered thereafter. They do not seem to be similarly circumstanced with the co accused who have been granted

bail/anticipatory bail earlier. The petitioners are in custody for close to two years. Offence, if proved, shall attract mandatory life imprisonment.

Considering the material on record and prima facie involvement of the petitioners in the alleged offence, prayer for bail is rejected at this stage.

The application for bail is thus disposed of. Case diary be returned.
