Petitioner is aggrieved by the factum of reduction of maintenance passed in a revisional application while considering the issue of stay.

Records of the case reflect that the said revisional application being Criminal Revision No. 721 of 2022 is pending before learned Additional District and Sessions Judge, Fast Track Court No.1, Barrackpore. The subjectmatter relates to Misc. Case No. 495 of 2022 wherein by an order dated 25.11.2022, the learned Judicial Magistrate, 2nd Court, Barrackpore was pleased to award interim maintenance of Rs.7000/- per month. While considering the issue relating to stay, the learned sessions court reduced the interim maintenance to the tune of Rs.3000/- per month which is the point of grievance of the petitioner. I find that the revisional application is still pending in the year 2024 on the issue relating to interim maintenance and as has been pointed out by the learned advocate for the

petitioner that the next date is fixed in the month of July 2024, I direct the learned Additional District and Sessions Judge, Fast Track Court No.1, Barrackpore to dispose of the Criminal Revision No. 721 of 2022 by 31.08.2024. The learned revisional court will fix as many dates as it deems fit and proper, but will not stretch the time line as fixed above.

In case there is any non-cooperation from the part of the respective parties and/or any dilatory tactics adopted, the learned revisional court will vacate the interim order and will revive the order so passed by the learned Judicial Magistrate, 2nd Court, Barrackpore in Misc. Case No. 495 of 2022. With the aforesaid observations, the revisional application being CRR 2744 of 2023 is disposed of. Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
