The petitioners claim to be the recorded owners of the plot in question and complain that the private respondents have encroached upon the portion of the P.W.D. road adjoining the said plot, thereby obstructing egress and ingress of the petitioners. The petitioners submitted a representation before the concerned authority in this regard on 14th July, 2022 which is yet to be considered.

The petitioners pray for direction upon the authority to consider the representation at the earliest.

It is submitted on behalf of the private respondents that no portion of the P.W.D.

road has been encroached upon by the respondents.

Learned counsel for the State respondents submits that the 4th respondent be directed to consider the representation of the petitioner, in accordance with law.

In view of the above, the writ petition is disposed of directing the 4th respondent to consider and dispose of the representation submitted by the petitioners dated 14th July, 2022 within three months from the date of communication of this order after affording reasonable opportunity of hearing to all the interested parties including the petitioners and the private respondents, in accordance with law.

W.P.A. 18156 of 2022 is disposed of.

There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
