Mr. Debnarayan Patra, Mr. Arijit Bera ...for the petitioners Mr. Tanoy Chakraborty, Mr. Arindam Mitra ...for the State Learned counsel for the petitioners submits that the petitioners applied for registration of deed. However, the respondent-authorities were of the opinion that the stamp papers, on which the deed was executed, were forged.
In order to obviate unnecessary wastage of time, the petitioners are agreeable to put in the amount equivalent to the stamp duty on which the deed was executed, for the purpose of getting delivery of the registered deed.
Upon hearing learned counsel for the parties, W.P.A. No. 17771 of 2023 is disposed of by directing the petitioners to deposit the amount equivalent to the stamp duty paid on the deed in question with the registering authorities at the earliest.
Upon such deposit being made, the respondent no. 4, that is, the Additional District Sub-Registrar, Midnapore, shall hand over the registered deed-inquestion, bearing Deed No. 2565 of the year 1990, to the petitioners at the earliest thereafter, positively within a fortnight from such deposit being made by the petitioners.
There will be no order as to costs.
Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance of all necessary formalities.
