The petitioner is aggrieved by an order dated 2nd September, 2021 passed by the District Controller, Food and Supplies.

By the said order, the District Controller rejected the application of the petitioner who is the grand-daughter of the original MR Dealer to be appointed on compassionate ground on account of the fact that she is not a family member according to Sub-Clause 3(1) of the West Bengal Kerosene Control Order 1968. The said control order was amended by the notification dated 4th June, 2021. The Single Judge has rightly found that the grand-daughter is not eligible member of the family for compassionate appointment as MR Dealer for kerosene.

In that view of the matter, the impugned order dated 5th October, 2021 calls for no interference.

F.M.A. 232 of 2022 shall stand dismissed.

Interim orders, if any, shall stand vacated.
7.
There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
