Mr. Shamim-ul Bari, Advocate ......for the Petitioner Mr. Biswabrata Basu Mullick, Advocate Mr. Ranjan Saha, Advocate ......for the State When the writ-petition is taken up for consideration, Mr. Shami-ul Bari, learned Advocate representing the petitioner, submits that vide order dated May 19, 2022 virtually the writ-petition was disposed of by granting leave to the petitioner to file afresh.
However, on perusal of the order dated May 19, 2022, it appears that though explicitly it was not recorded in the order that the writ-petition is disposed of but the purport of the order goes to show that in effect, the writ-petition was disposed of.
In view of the order dated May 19, 2022 passed by the coordinate Bench, the Department is directed to treat this writ-petition as disposed of and not to show the same as pending in the system.
