The plea of the petitioner is that the river Rupnarayan flows on the northern side of the dwelling house of the petitioner and one canal of the said river flows on the western side having a sluice gate to regulate and control of the river water and during monsoon the excess water is preserved.

In the writ petition the petitioner has made a prayer to issue a direction to the respondents to appoint technical staff for regulating and controlling sluice gate and also seeking a direction against the village committee to stop illegal fisheries in the agricultural field during the monsoon season.

Learned counsel for the State has informed that the sluice gate operates automatically depending upon the extent of flow of water. That apart we have also noticed that though the petitioner has questioned the decision of the village committee but no such details, dates, etc., or nature of the decision have been disclosed nor a copy thereof has been enclosed with the petition. The representation enclosed with the petition is only at the instance of the sole petitioner. No other villager appears to have raised any grievance. Paragraph 4 of the petition reveals that the case which the petitioner is raising is personal in nature. The allegations made in the petition are not substantiated with any documentary evidence. Hence, in the aforesaid circumstances of the case, we do not find fit to entertain the present public interest petition which is accordingly dismissed.
