It appears vide order dated 16th December, 2022 this Court granted leave to the learned advocate representing the applicant to amend the cause title of the contempt application by adding the present incumbent as additional contemnor/respondent.
Today, on perusal of the records it appears inadvertently the learned advocate for the applicant has amended the cause title of restoration application being CAN 5106 of 2018 which stood disposed of vide order dated 28th February, 2020 by a coordinate Bench.
The learned advocate for the applicant has prayed for further leave to amend the cause title of the contempt application in course of this day by adding the present incumbent as contemnor/respondent.
Such leave is granted to the learned advocate representing the applicant to amend the cause title of the contempt application in course of this day in order to add the present incumbent as additional contemnor/respondent. It has been submitted by Dr. Sutanu Kumar Patra, learned Counsel representing the alleged contemnors that the order passed by this Court has already been complied with in view of issuance of recommendation memo dated 15th December, 2022 in favour of the applicant. Such submission made on behalf of the alleged contemnors has not been disputed by the learned advocate representing the applicant. Accordingly, the contempt application stands disposed of since the order passed by the coordinate Bench has been complied with.
Contempt rule stands discharged.
Copy of the recommendation memo dated 15th December, 2022 issued in favour of the applicant is taken on record.
Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
