Sudeb Ghosh v. State Of West Bengal
20.12.2021 tkm/ct 28 C.R.M. 7778 of 2021 sl no.115 In Re : An application for bail under section 439 of the Code of Criminal Procedure in connection with Ranaghat P.S case no. 127/2020 dated 7.6.2020 under sections 326/302/34 IPC And In Re : Sudeb Ghosh ........ petitioner Mr. M Chatterjee Mr. D Majumder Mr. S Basu Roy ...... for the petitioner Mr. Sudip Ghosh Mr. Bitasok Banerjee ...... for the State Petitioner renews his prayer for bail. He submits there is inordinate delay in progress of trial.
Learned lawyer for the State opposes the prayer for bail and submits that the petitioner had absconded for about two decades and was ultimately arrested. Dates have been fixed for recording evidence in January 2022.
Having considered materials on record and in view of the prima facie involvement of the petitioner in the alleged crime, his prolonged abscondence and as his bail prayer was rejected on merits, we are not inclined to grant bail to the petitioner at this stage.
Accordingly, prayer for bail is rejected.
Trial court is directed to conclude the trial at an early date preferably within one year from the next date fixed before it for recording evidence without granting adjournments to either of the parties.
