According to the petitioner the respondent no. 9 is available within the jurisdiction of Rajib Nagar Police Station as informed by the Officers of Shastri Nagar Police Station. The said police stations are at Patna within the State of Bihar.

Accordingly, Netaji Nagar Police Station is directed not to proceed further with the instant case. Petitioner will exhaust his remedy before the jurisdictional High Court or before the learned jurisdictional Magistrate having authority to exercise powers under BNSS in respect of Rajib Nagar Police Station, Patna.

With the aforesaid observations WPA 18600 of 2024 is disposed of.

Pending connected applications, if any, be disposed of.

Report so submitted on behalf of the State be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioner. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
