Petitioner seeks quashing of G.R.Case No. 3620 of 2017 pending before the learned Additional Chief Judicial Magistrate, Bongaon, North 24 Parganas on the ground that there is no prima facie material against him under Section 325 or 354 of the Indian Penal Code. The injury reports indicate that injuries are simple in nature.

The petitioner seeks to withdraw the application and file an application under Section 227 of the Code of Criminal Procedure before the learned trial Court.

Such liberty is granted. The petitioner is at liberty to file a discharge application before the learned trial Court and canvass all the issues taken by him before this Court. Further liberty is granted to withdraw certified copies of documents filed herein upon furnishing photo copies thereof. CRR No. 3020 of 2024 is dismissed as withdrawn.
