Palas Dolui v. State Of West Bengal And ORS.
16.09.2022 Sl. No.56(DL) srm W.P.A. No. 18858 of 2021 Palas Dolui Vs.
The State of West Bengal & ors.
Mr. Keshab Chandra Das, Ms. Aparajit Mondal ....for the Petitioner.
Mr. Lalit Mohan Mahata, Mr. Rudranil De ...for the State-respondents.
The petitioner alleges that the authorities have not considered his prayer for compassionate appointment. The father of the petitioner was a gram panchayat karmee of Dwarhatta Gram Panchayat, District-Hooghly and expired on May 3, 2021, while he was in service. On May 11, 2021, the mother of the petitioner filed a handwritten application before the Block Development Officer, Haripal Development Block, Hooghly. The said handwritten application was countersigned by the Pradhan of Dwarhatta Gram Panchayat, Hooghly. Again, another application was filed before the District Panchayat and Rural Development Officer on June 21, 2021. The petitioner alleges that no steps have yet been taken by the authorities.
It is claimed that subsequently, the petitioner has filed an application in the prescribed form before the competent authority. A copy of such application has been filed in Court and the same is taken on record. Under such circumstances, the writ petition is disposed of with a direction upon the respondent No.5, i.e. the District Panchayat and Rural Development Officer, Hooghly to take necessary steps on the basis of the application filed by the petitioner. If the name of the petitioner is recommended and proposed for appointment on compassionate ground, intimation to that effect shall be provided to the petitioner. It is made clear that seriality shall be maintained. However, if the case of the petitioner cannot be recommended, reasons for such decision shall be intimated to the petitioner, within three months from date. It is expected that the concerned authority shall complete the process of enlistment, if the petitioner is found otherwise eligible, within a period of six months from the date of communication of this order. The writ petition is, thus, disposed of.
There shall be no order as to costs.
Parties are to act on the basis of the server copy of this order.
