Learned advocate for the petitioner submits that she preferred a naraji petition before the learned Judicial Magistrate, 5th Court, Asansol, Paschim Bardhaman which is pending for about 9 months. It has also been informed that the next date has been fixed on 12th September, 2023. Having regard to the fact that the present petitioner prays for further investigation and intends to pursue with the application so preferred before the learned Judicial Magistrate, 5th Court, Asansol, Paschim Bardhaman, I direct the learned magistrate to dispose of the application under Section 173(8) Cr.P.C. filed at the instance of the complainant namely Arupa Modak on 12th September, 2023 or within a month thereafter.

With the aforesaid observations, CRR 2746 of 2023 is disposed of.

Pending application, if any, is consequently disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent certified copy of this order, if applied for, be made available to the parties upon compliance of such requisite formalities.
