The writ petitioner claims to be a tenant under one Nesar Ahmed in respect of the Premises No. 7/3/H/4, Dr. M. N. Chatterjee Sarani, Kolkata. He has prayed for liberty to run a hotel thereat and effect repairs in his premises. Admittedly, the parent landlord has filed T. S. No. 192 of 2012 which is now pending before the learned 1st Civil Judge(Junior Division), Sealdah, 24 Parganas. The dispute between the petitioner and the private respondent is purely civil in nature and appropriate steps may be taken by the petitioner either in the pending suit or any other civil proceedings that may be taken up in accordance with law.
Narkeldanga Police shall, however, ensure that there is no breach of peace in the area.
The writ petition is disposed of.
There will be no order as to costs.
