Ms. Reshmi Bothra, learned advocate appears for the Union of India/respondent no.1.

Considering the issue in this writ petition and considering the prayers made therein, this Court is of the

firm view that the issue in this wit petition should be adjudicated before the jurisdictional Central Administrative Tribunal.

Accordingly, the petitioner shall be at liberty to file appropriate proceeding on the self-same cause of action and on the self-same issue as in this writ petition before the jurisdictional Central Administrative Tribunal within a period of four weeks from date.

In the event, such a proceeding is filed before the jurisdictional Central Administrative Tribunal, the Administrative Tribunal shall decide and come to its logical conclusion with reasons following the due process of law as expeditiously as possible.

It is made clear that this Court has not gone into the merits of the claim of the petitioner and of the writ petition. All points are kept open for the parties to urge before the jurisdictional Tribunal.

With the above observations and directions, this writ petition, WPA 17685 of 2025 stands disposed of. without any order as to costs.
