The petitioner contended that the matter is pending since 2017 and a direction may be given to the learned court below for expeditious disposal of the case and to dispose of the same preferably within a period of six months.

Since the prayer is innocuous, C.O. no. 2410 of 2022 is disposed of with a direction upon the learned Judge, Family Court, Calcutta to make every endeavour to dispose of the Matrimonial suit being MAT suit no. 78 of 2016 as expeditiously as possible preferably within a period of six months. Since no affidavit-in-opposition has been filed by the opposite party, the averments made in the petition shall be deemed to be not admitted by the opposite party.

Accordingly, C.O. 2410 of 2022 is disposed of.
