This is an application under Section 24 of the Code of Civil Procedure filed by the wife, the respondent of the Matrimonial Suit No. 1538 of 2021 filed by the husband, the opposite party herein, seeking dissolution of marriage between the parties by a decree of divorce.

The said matrimonial suit is pending before the Court of the learned Additional District Judge, Barrackpore, District : 24 Parganas (North).

The petitioner is praying withdrawal of the said suit from the Court where it is now pending and transfer of it to the Court of learned Additional District Judge at Kandi, District: Murshidabad.

The husband is not objecting to the said prayer of the wife.

Therefore, let the Matrimonial Suit No. 1538 of 2021 be withdrawn from the file of the learned Additional District Judge at Barrackpore, District : 24 Parganas (North) and be transferred to the Court of the learned District Judge, Murshidabad who on receipt of the records of the said matrimonial suit shall transfer it

to any Court competent to try and dispose of the said suit under his judgeship at Kandi.

Irrespective of transmission of the record of the said matrimonial suit, the parties are directed to appear before the learned District Judge, Murshidabad on June 20, 2022 for further direction, upon production of a server copy of this order.

The learned Additional District Judge at Barrackpore, District: 24 Pargnas(North) shall expedite the transmission of the record of the said matrimonial suit to the Court of the learned District Judge at Murshidabad.

The department is directed to communicate this order to the concerned Courts immediately.

CO 2027 of 2021 is disposed of with the above terms without any order as to costs.

Since no affidavit-in-opposition has been invited from the opposite party, the allegations made in the application are deemed to have been denied by them. Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance of all requisite formalities.
