Petitioner is in custody for about 501 days. He submits co-accused have been enlarged on bail. Accordingly, he prays for bail.

Learned Advocate for State opposes the bail prayer. 3.

We have considered the materials on record. Petitioners are in custody for a considerable period of time. There is no possibility of trial concluding in the near future. Co-accused have been enlarged on bail. Under such circumstances, we are of the opinion further detention of the petitioner is not necessary.

Accordingly, the petitioner viz., Nur Mahammad Shek @ Sk. shall be released on bail upon furnishing a bond of Rs.10,000/- with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Chief Signed By : ALOK SETH High Court of Calcutta 6 th of August 2024 04:51:05 PM

Judicial Magistrate, Nadia at Krishnagar subject to condition that he shall appear before the trial court on every date of hearing until further orders and shall not intimidate witnesses or tamper with evidence in any manner whatsoever. 6.

In the event the petitioner fails to appear before the trial court without any justifiable cause, the trial court shall be at liberty to cancel his bail in accordance with law without further reference to this Court.
