1. None appears on behalf of the State respondents.

2. Affidavits of service filed in Court today are taken on record.

3. In response to a public notice published by the Department of Land & Land Reforms and Refugee Relief & Rehabilitation Land Policy Branch vide Memo No. 1924-LP/5M-30/15 dated 16th August, 2021, the petitioners applied for settlement of the subject land in their favour before the Collector, North 24 Parganas having camp office in the premises of Dum Dum Municipality.

4. A further notification was published by the same department being No. 3049-LP/5M-30/15 dated 31st July, 2023 declaring the policy in respect of the land of the Dum Dum Cantonment.

5. The application filed by the petitioners for settlement of land in 2021 is pending consideration till date.

6. In the absence of the State respondents the matter cannot be decided conclusively.

7. Without entering into the merits of the application and the claim of the petitioners, the instant writ petition is disposed of by directing the respondent no. 6 being the Additional District Magistrate and the District Land and Land Reforms Officer, North 24 Parganas to take a decision in the matter in terms of the public notice published by the Government on 16th August, 2021 and the subsequent notification dated 31st July, 2023 at the earliest but positively within a period of twelve weeks from the date of communication of this order.

8. If required, the petitioners may be afforded an opportunity of hearing for producing documents in support of their claim. A reasoned order shall be passed by the aforesaid authority and communicated to the petitioners immediately thereafter.

9. Learned advocate representing the petitioners is directed to forward a copy of the application and a copy of the public notice dated 16th August, 2021 and the notification dated 31st July, 2023 along with all other relevant supporting documents to the aforesaid respondent at the time of communicating the order of the Court.

10. The writ petition stands disposed of.

11. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all the requisite formalities.
