The present revision of the year 2019 has been preferred against the order dated 22.07.2019 passed by the learned Executive Magistrate, Kharagpur in Case No. 777 of 2018 in a proceeding under Section 144 (2) Cr.P.C.. As there is no representation on behalf of the State, Ms. Puspita Saha, learned counsel for the State present in Court be appointed to represent the State in this case. Learned Public Prosecutor is requested to regularize her appointment.

On perusal of the said order under Section 144 of the Cr.P.C., it appears that the case has been dropped on the basis of the report of the OC, Sabang P.S. by the learned Executive Magistrate, Kharagpur, on the findings that the dispute is civil in nature.

Considering the nature of the proceedings under Section 144 Cr.P.C., this Court finds no irregularity made in the order of the learned Executive Magistrate.

Accordingly, the present revisional application is disposed.

All connected applications, if any, stand disposed of. Interim order, if any, stands vacated.

Let a copy of the order be sent to the learned trial court for compliance.
