The petitioner filed a copy of letter along with postal receipt which be kept with the record.

This is an application for expeditious disposal of Title Suit No.52 of 2019 pending before the learned Civil Judge (Junior Division), 1st Court, Bolpur, Birbhum. It is submitted on behalf of the petitioner that the matter is pending since 2019 and the plaintiff/petitioner is suffering a lot as the suit has not been progressed. He further submits that the defendant/opposite party is the absolute owner of the suit property and the plaintiff/petitioner has no locus standi to file the aforesaid title suit which is mala fide, arbitrary and should be dismissed in limine.

Considering the facts and circumstances of the case, it appears that the prayer made by the petitioner/defendant is very innocuous and as such the learned trial court is directed to make every endeavour to dispose of the suit as early as possible preferably within a period of ten months from the date of communication of the order.

Accordingly, C.O. 2028 of 2021 is disposed of. There will be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all necessary formalities.
