The State of West Bengal & ors.

Mr. Bikash Ranjan Bhattacharya Mr. Rabi Sankar Chattopadhyay Mr. Sayan Chattopadhyay Mr. Ayanava Acharya ..... for the petitioners Mr. Alok Kr. Ghosh Mrs. Sima Chakraborty .... For the KMC

1. Challenging the demand notice dated 17th August, 2024 demanding security deposit of Rs. 2,15,99, 303/- from the petitioner in relation to retention of unauthorized construction and change of user, the present writ petition has been filed.

2. Today, Mr. Ghosh, learned advocate representing the municipal authorities would submit that they are no longer insisting for the aforesaid security deposit in relation to permitting the petitioners to participate in the hearing of demolition proceedings. Since the municipal authorities, no longer insist for the security deposit, I am of the view, nothing survives in the writ petition. However, at the same time the aforesaid order should not be construed as an order permitting the municipal authorities to regularize any part or portion of the unauthorizedly constructed portion of the petitioners' property.
