And In the matter of : Raunak Shaw @ Raushan Shaw Raoshan Sah ...... petitioner Mr. Debapriya Majumder ....for the petitioner Ms. Sayanti Santra Ms. Ankita Paul ....for the State
1. Affidavit of service filed in Court today be kept on record.
2. It is submitted by the learned advocate for the petitioner that he is innocent and falsely implicated. More so, dispute pertains to a plot of land, which has been culminated into filing of this false complaint against him.
3. The learned prosecution raises strong objection and opposes the prayer for bail.
4. Heard the submissions of both the learned advocates.
5. Perused the materials in the case diary.
6. On careful consideration of the materials in the case diary and the statements made under section 161 of the Cr.P.C. as well as the statement given by the victim lady and more importantly considering the fact that there is a
mass petition against the present petitioner by the local people alleging about his conduct, behaviour and nuisance and extreme fear created amongst the senior citizens and children of the area, this Court is of the view that benefit of section 482(2) of BNSS may not be extended in favour of the petitioner. Hence the prayer for anticipatory bail is rejected.
