Affidavit-of-service filed on behalf of the petitioner is taken on record.

Petitioner prays for sanction of post graduate scale of pay on acquiring higher educational qualification of M.A. in History in 2010.

On perusal of the writ petition it appears that the petitioner was an organizing teacher, who was accorded approval of appointment considering his educational qualification of B.Com/B.A. with effect from 1st May, 2000. Approval memo is at page 16 of this writ petition which goes to show that petitioner was appointed against the post of Assistant Teacher earmarked for a candidate having pass graduate qualification. If petitioner is granted approval of appointment against a post which is meant for pass graduate qualification, petitioner will not be illegible

to get post graduate scale of pay on acquiring educational qualification subsequently as the staff pattern of the school shall not permit the petitioner to enjoy the same.

In view of aforesaid consideration no relief can be granted to the petitioner.

Hence, writ petition stands dismissed.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
