The writ petitioners complain of alleged inaction by Basanti Police Station, Baruipur Police District. Counsel for the State submits that there are three civil suits pending between the parties being Title Suit No. 186 of 2017, Title Suit No. 544 of 2018 and Title Suit No. 60 of 2020 before the learned Civil Judge (Junior Division) 2nd Court at Baruipur, South 24 Parganas.

It appears to this Court that the disputes are primarily civil in nature and the parties may agitate their grievance in the pending civil suits.

Basanti Police Station shall comply with any orders specifically passed by the Civil Court on them. It shall be ensured that there is absolutely no breach of peace in the area.

With the aforesaid directions, the instant writ petition shall stand disposed of.

Instructions of Office-in-charge, Basanti Police Station dated 16th November, 2022 addressed to the Government Pleader, High Court, Calcutta is taken on record.

There will be no order as to costs.

All parties are directed to act on a server copy of this order duly downloaded from the official website of this Court.
