Notice has been served upon the respondent no. 11 and not responded.

Counsel for the ECL in his usual fairness submits that the petitioner is the recorded second wife of the deceased employee, who has been allowed compassionate employment. The name of the second wife after the death of the first wife has been recorded in the records of ECL but for some strange reason remains unrecorded in the records of Coal Mines Provident Fund Organisation (CMPFO).

The petitioner shall therefore file necessary forms and complete all formalities and the officials of the CMPFO shall assist the petitioner in completing and filling up such forms.

It is expected that the petitioner shall approach the office of the CMPFO within four weeks from date. P.F. and other benefits on account of late husband of the petitioner shall be released to her within a period of one month thereafter.

The writ petition is disposed of.

There will be no order as to costs.

All parties are directed to act on a server copy of this order duly downloaded from the official website of this Court.
