The Sub-Assistant Engineer, P.W. Department, Baranagar Municipality has filed a report before this Court upon spot inspection wherefrom it appears that no unauthorized construction has been detected. It has been reported that the buildings and the structure of the premises are very old and in dilapidated condition and constructed long ago. At present there is no civil work or any construction work going on.

From the report forwarded by the engineer of the Municipality, the allegation of the petitioner of unauthorized construction remains unsubstantiated.

In view of the above, no relief can be granted to the petitioner in the instant case.

The writ petition fails and is hereby dismissed. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
