ct.no.35 W.P.A.17734 of 2025 Bishnupada Das

Versus

The State of West Bengal & Ors.

Ms. Nandini Sharma.

...for the petitioner.

Mr. Amitabrata Roy Mr. Sudipta Panda Mr. Shibasish Banerjee.

...for the State-respondents.

Affidavit-of-service filed by the petitioner be kept with the record.

Petitioner is aggrieved by the illegal encroachment at the behest of the private respondents and to that effect informed the local police station. However, in spite of informing the police station, no steps have been taken.

State has submitted a report. Report reflects that there is a dispute relating to demarcation of land. However, in spite of the same, police authorities in order to prevent breach of the peace have already drawn up proceedings under Sections 126/135(3) of the BNSS. Police authorities would as such ensure that there is no violation of the law and order which is blown out of proportion.

With the aforesaid observations, WPA 17734 of 2025 is disposed of.

There will be no order as to costs.

Report submitted by the State be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioner. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
