Pursuant to the order dated 17.05.2024 as passed by a coordinate Bench in this appeal, the appellant, Karuna Pattanayak @ Kushadhyaj is produced before this Court. 2.

The appellant files his self-attested photocopy of Aadhaar Card. On being asked, the appellant says that he is not represented by any lawyer. He further says that since the respondent nos. 2 to 5 are no more in the earth, he is not willing to proceed with the matter.

It reveals from the file of papers that the instant appeal is preferred challenging the judgment and order of acquittal dated 24.04.2007 as passed by the learned Judicial Magistrate, 6th Court, Midnapore, Paschim Midnapore in G.R. Case No. 67 of 1999.

In view of the submission of the appellant, the instant appeal being CRA 435 of 2007 stands hereby withdrawn and is thus disposed of.

The self-attested photocopy of the Aadhaar Card as filed by the appellant is taken on record.

Department is directed to forward a copy of this order along with LCR to the learned trial Court forthwith. (Partha Sarathi Sen, J.)
