Learned advocate appearing for the petitioner submits that, the petitioner was falsely implicated. He submits that, the police seized the prescriptions issued by the petitioner to the defacto complainant. However, the contents of the First Information Report does not speak of any prescription being issued by the petitioner.

In response to the queries of the Court, learned advocate for the petitioner produces the certificates of the petitioner including the registration number.

Learned advocate appearing for the State draws the attention of the Court to the contents in the case diary including the statement recorded under Section 164 of the Code of Criminal Procedure (Cr. P. C.).

Considering the gravity of the offence and the involvement of the petitioner therein as well as the statements recorded under Section 164 of the Cr. P. C., we are unable to grant anticipatory bail to the petitioner.

Accordingly, prayer for anticipatory bail of the petitioner is rejected and the application being CRM 7806 of 2021 is dismissed.
