This matter was fixed upon mentioning by the learned Advocate for the petitioners citing urgency. However, when the matter is taken up for hearing, none appears on behalf of the petitioners. No accommodation has been sought for either.

This application under Article of the Constitution of India is at the instance of the defendants praying for a direction upon the learned Civil Judge (Senior Division), 1st Court at Contai, Purba Medinipur to dispose of Title Suit No.122 of 2016 expeditiously. From the order-sheets appended to this revisional application, this Court finds that service of summons upon the defendants is not yet complete. Therefore, the suit is not yet ready for hearing. In view of the above, I am not inclined to pass any direction for expeditious hearing at this stage. With the above observation, C.O.2646 of 2024 stands disposed of.

There shall be no order as to costs.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
