Mr. Prajnadeepta Roy Mr. Sayan Das ....for the petitioners Mr. Subradip Roy ......for the respondent The respondent/University had been given time on 29th August, 2022 to take instructions in the matter. As of 18th November, 2022, which is today, the University has still not come up with any instructions. The undisputed facts are as follows.

The petitioners supplied material to the Soil Testing Laboratory of the University in 2018. The first supply was made on 3rd May, 2018 and the last supply was made on 9th June, 2018. The petitioners raised several invoices for the supplies made on the University on 28th May, 2018 and 26th July, 2018. The invoices are on record. The petitioners issued a legal notice on the University on 15th July, 2022 which is also on record. The amount mentioned in the legal notice is of Rs. 24,96,921/- and the amount mentioned in the invoice dated 16th July, 2018 is an additional Rs. 5,78,922/-. The University has not responded to the legal notice and has not made any payment against the

invoice till date. This position is not disputed on behalf of the University.

The University has obviously not taken any point to rebut the claim of the petitioners from 28th May, 2018 till date.

WPA 18228 of 2022 is accordingly allowed and disposed of with the direction on the respondent University to pay the amount of Rs. 30,74,213/- to the petitioners within a period of six weeks from date. Since the petitioners have been kept waiting for payment from 2018 onwards, the amount shall also carry interest at the rate of 6% from 16th July, 2018 till the date of payment.
