The report in the form of affidavit on behalf of the respondent no. 6 and the exception thereto filed by the petitioner are taken on record.

The petitioner contends that the objection raised by the petitioner was not considered by the authority in accordance with the tender documents. The learned senior counsel for the petitioner has taken the Court through the findings and the redressal as disclosed in the report.

Upon hearing the petitioner it appears that, the grievances of the petitioner and the manner in which the same has been redressed by the Executive Engineer are too technical in nature.

The petitioner is, admittedly, the L2 bidder and the authority has found the L1 bidder to be the

most eligible. It does not appear that there is any violation of the principles of natural justice or any error in the decision making process requiring interference by the writ Court.

In the view of the above, the Court is not inclined to exercise jurisdiction in this matter. 6.

The writ petition fails and is hereby dismissed.
