Learned advocate appearing for the petitioner submits that, there was a love relationship between the petitioner and the victim. The victim is an adult.

Learned advocate appearing for the State draws the attention of the Court to the statement recorded under Section 164 of the Code of Criminal Procedure (Cr. P. C) of the victim. He submits that the victim refused to undergo medical test. Considering the materials in the case diary and considering the statement recorded under Section 164 of the Cr. P. C. and considering the gravity of the offence and the nature of the incident and the complicity of the petitioner therein, we are not in a position to grant anticipatory bail to the petitioner.

Accordingly, prayer for anticipatory bail of the petitioner is rejected and the application being CRM 7812 of 2021 is dismissed.
