The report also speaks that statement of the victim girl has been recorded under Section 183 of the BNSS.

There are other issues which have been reduced to writing by the investigating officer of the case.

However, the investigating officer has prayed before the learned CJM, Purulia for addition of Section 64 of the

BNSS and Section 6 of the POCSO Act.

In course of time, on instruction, learned advocate for the State submits that the case has been transmitted to the learned Special Court under the POCSO Act.

In view of the victim girl being recovered, steps taken by the investigation officer in consonance with the provisions of the BNSS; POCSO Act and the case being transmitted to the learned Special Court (under POCSO Act), I am of the view that the investigation of Jhalda P.S.

Case No. 193 of 2024 be taken to its logical conclusion by the investigating agency.

Having regard to the stage of the investigation and the efforts which have been put in by the investigating agency, I am of the opinion that further pendency of the writ petition is unwarranted.

Accordingly, WPA 17803 of 2025

is disposed of.
