Petitioner has made a representation to the Superintendent of Police, Murshidabad Police District regarding the subsequent events at the behest of the private respondent nos.4 to 6.
State has submitted a report. Report reflects that earlier Sagarpara P.S. Case No.428 of 2025 dated 11.05.2025 was registered for investigation under the relevant provisions of BNS and on conclusion of investigation charge-sheet has been submitted before the jurisdictional court.
In view of the subsequent events being informed to the superior officer of police, the Superintendent through the authorized superior officer would conduct an enquiry in respect of the
allegations and inform the outcome to the present petitioner.
Additionally, it is directed that if the accused persons are on bail in connection with Sagarpara P.S.428 of 2025, petitioner would file an application before the jurisdictional court for cancellation and/or modification in relation to the bail already granted. Learned Magistrate would assess regarding the genuinity of the allegations, issue notice upon the accused persons, call for a report from the police authorities and thereafter pass necessary directions as he deems fit and proper.
With the aforesaid observations, WPA 17797 of 2025 is disposed of.
There will be no order as to costs.
Report submitted by the State be kept with the record.
A copy of the report be handed over to the learned advocate appearing for the petitioner. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
