VS THE STATE OF WEST BENGAL & ORS.

(Through Video Conference) None present for the petitioners.

Record perused.

This writ petition was filed in the year 2014. Thereafter more than seven years have passed and the petition has been repeatedly adjourned without there being any substantive order of this court.

Perusal of the record it reflects that the petitioners have challenged the notification dated 19th of February, 2014 whereby the powers of Additional Chief Judicial Magistrate were conferred upon one Smt. Sremoyee Chakraborty, learned Judicial Magistrate, 1st Class under Section 11(2) of the Cr.P.C.

It is not known if after a lapse of more than seven years the grievance of the petitioners is still surviving. That apart, the Judicial Magistrate to whom the power were conferred was not impleaded as respondent in this petition.

In the circumstances of the case, we do not find any justification to keep the matter pending. Since no one has come forward to prosecute the petition, hence,

the petition is dismissed in default.
