Sonali Begum Sk @ Sonali Farida Sekh v. State Of West Bengal
14.08.2025 Item No.17 Ct. No. 446 PG C.R.M.(A) 2771 of 2025 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure corresponding to section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023, in connection with Sonarpur Police Station Case No. 986 of 2024 dated 18.07.2024 under Sections 420/406/506/182/34 of the Indian Penal Code, pending before the learned Additional Chief Judicial Magistrate, Baruipur, South 24-Parganas And In the matter of : Sonali Begum Sk. @ Sonali Farida Sekh ...... petitioner Mr. Dipankar Aditya Mr. Bidyut Baran Biswas Mr. Ranjit Rath Ms. Aishwaryia Priya Saha ....for the petitioner Ms. Faria Hossain, Ld. APP Ms. Diksha Ghosh ....for the State
1. It is submitted on behalf of the learned advocate for the petitioner that she is not an FIR named accused person and the FIR named accused person is enlarged on bail. It is further submitted that she has been falsely implicated and in nowhere connected.
2. Learned advocate for the prosecution raises vehement objection and argues that it involves several rackets involving several agents and the present petitioner is the kingpin of the entire matter.
3. Heard the submissions of both the learned advocates.
4. Perused the materials in the case diary.
5. After going through the materials in the case diary and the various statements made by not only the accused persons
but also some of the victims, the bank statement of the present petitioner and her involvement, which, prima facie reveals from the fourcorners of the case diary, this Court is of the view that extending the benefit of section 482(2) of BNSS at this stage, in favour of the petitioner would jeopardize the process of investigation.
6. Hence the prayer for anticipatory bail is rejected. (Chaitali Chatterjee (Das), J.)
