For the State This is an application seeking expeditious disposal of a proceeding in which the charge sheet was submitted under Sections 323, 324,341, 506 and 34 of the Indian Penal Code. Let a copy of this revisional application be served upon Mr. Arijit Ganguly and Ms. Manisha Sharma learned counsels who ordinarily appear on behalf of the State. They are requested to appear in this matter. Their engagement may be regularised by the competent authority of the State in due course. Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner is a de facto complainant in this case. Although he lodged the F.I.R. on 08.03.

2021, till date the proceeding could not be concluded. The allegations are about the encroachment of property. In fact, the private opposite parties have been threatening the petitioner for which he had to move the Writ Court and an appropriate direction was passed in this regard. He also submits that the next date is fixed before the learned Magistrate for appearance of the accused.

Learned counsel appearing on behalf of the State submits that within a month of lodging the F.I.R. the charge sheet was submitted. As such, there is no need for any interference.

I have heard the submissions of the learned counsels appearing on behalf of the petitioner and State and have perused the revision petition.

It appears that within a month of lodging of the F.I.R., the Charge Sheet was submitted.

The next date is fixed for appearance.

As such, I do not think that there was any delay in conducting the proceeding.

In view of the above, I do not find any need to interfere with the impugned proceeding.

Accordingly, the revisional application is dismissed. However, there shall be no order as to costs. Urgent photostat certified copy of this order may be supplied to the parties expeditiously, if applied for. (Jay Sengupta, J.)
